Proposed Revocation of Community Land Status

13 Little Paxton Street, Willaston

1. Introduction

This report has been prepared in accordance with section 194(2) of the Local Government Act 1999 (the Act) to support Council’s proposal to revoke the community land classification of the land located at 13 Little Paxton Street, Willaston, being Certificate of Title Volume 5285 Folio 463.

2. Description of the Land

The land is owned by the Town of Gawler and is currently classified as community land pursuant to section 193 of the Act.

The site was historically used as a landfill facility. The landfill has since been closed and remediated. Council retains ongoing environmental monitoring and compliance obligations associated with its former use.

The land does not provide public access, recreation facilities or community use.

3. Current Use and Purpose of the Land

The land is currently utilised for operational purposes associated with Council’s depot activities. This includes:

  • Storage of plant and equipment
  • Stockpiling of materials
  • Storage and processing of green waste
  • These activities are operational in nature and support Council’s service delivery functions.

    The land is not used for recreational, community or public open space purposes.

    4. Reasons for the Proposed Revocation

    Council proposes to revoke the community land classification to ensure that the land’s statutory classification reflects its current and intended operational use.

    The land:

  • Is not accessible to the public
  • Does not provide community or recreational benefit
  • Is required for essential operational depot-related activities
  • Has historical landfill constraints that limit its suitability for community use
  • Retention of community land status is no longer appropriate given the land’s function and operational purpose.

    5. Proposed Future Use

    Following revocation, the land will continue to be used for Council operational purposes associated with depot activities, including plant storage, materials management and green waste processing.

    There is no proposal to dispose of the land at this time.

    Revocation will provide Council with greater flexibility in managing the land in accordance with its operational requirements, while continuing to meet environmental compliance obligations.

    6. Impact on the Community

    The proposed revocation is not expected to adversely impact the community because:

  • The land is not publicly accessible
  • The land does not provide open space, recreational or community facilities
  • There will be no loss of public amenity
  • The land’s continued use for operational purposes supports Council’s service delivery across the broader community.

    7. Planning and Strategic Considerations

    The continued operational use of the land aligns with Council’s infrastructure and service delivery functions.

    The proposed revocation ensures consistency between the land’s classification under the Act and its actual use.

    Environmental monitoring obligations associated with the former landfill will remain in place irrespective of land classification.

    8. Consultation

    In accordance with section 194 of the Act, Council will undertake public consultation prior to making a final decision on the proposed revocation. All submissions received will be considered before Council determines whether to proceed.
